Our experience in creditor’s rights, corporate insolvency, and restructuring

Dunlap Bennett & Ludwig’s bankruptcy lawyers have decades of collective experience appearing in bankruptcy and related matters and reorganizing and restructuring businesses. Many of our bankruptcy attorneys are former business owners and finance professionals, so they have legal experience as well as practical business skills. This means that our bankruptcy team can use their understanding of your needs to strengthen their advocacy on your behalf.

Our law firm advocates for creditors’ rights in a variety of ways. We assist with claims filing, claims disputes, and protecting secured and unsecured creditors’ rights throughout the Chapter 11 plan confirmation process. We also represent debtors in formal Chapter 11 proceedings, including cash collateral hearings, motions to approve debtor-in-possession (DIP) financing, hearings relating to the disposition of assets, hearings seeking approval of disclosure statements, plan confirmation proceedings, and claim objections.

When it comes to out-of-court reorganizations and workouts, our attorneys work to understand the specifics of your financial situation and advise on bankruptcy, other alternatives, and potential reorganization and workout strategies.

  • Prosecute and defend bankruptcy adversary proceedings related to breaches of fiduciary duties, fraudulent and preferential transfers, business torts, and other issues
  • Represent debtors in proceedings regarding executory contracts, intellectual property licenses, lien stripping, and related matters
  • Assist in negotiating workouts of delinquent accounts and securing new financing
